Terms of Service
The agreement between ON5 and the businesses and people who fund an account, issue cards and use the ON5 API at ON5.com.
These terms are the agreement between you and KAANCH LIMITED (Business Registration No. 78360503) (“ON5”, “we”, “us”), a company incorporated in Hong Kong with its registered office at Unit 1411, 14/F, Cosco Tower, 183 Queen's Road Central, Sheung Wan, Hong Kong. They govern your use of ON5.com, the dashboard, the API and every card issued through us. By creating an account you accept them.
1. Who you are contracting with
ON5 is a trading name. The ON5.com platform and the ON5.org site are operated by KAANCH LIMITED, Business Registration No. 78360503, registered at Unit 1411, 14/F, Cosco Tower, 183 Queen's Road Central, Sheung Wan, Hong Kong. Kaanch Limited is the entity you contract with, the entity that holds the platform’s relationships, and the entity to name in any legal notice.
Kaanch Limited is also the company behind Kaanch Network, the blockchain that carries ON5 activation payments and is intended as the settlement layer beneath the ON5 Card Network. Seeing that name on an invoice or a bank reference is expected, not a sign that something is wrong.
2. What ON5 does
ON5 is a card issuing platform. You fund an account with stablecoins, and we issue virtual cards on the Visa and Mastercard networks that carry your brand and are given to the cardholders you choose. We hold the relationships with the issuing partners and run the processing behind the programme.
ON5 is not a bank. Your account balance is not a deposit, earns no interest, and is not covered by any deposit guarantee or insurance scheme. It is a record of funds held for the purpose of loading cards.
The ON5 Card Network at ON5.org is a separate project, in development and testing. No card is issued on it and nothing in these terms promises that any will be.
3. Who may use ON5
- You must be at least 18 and able to enter a binding contract.
- If you accept these terms for a business, you confirm you are authorised to bind it, and “you” means that business.
- You must not be resident in, or acting for someone in, a country or on a list subject to sanctions that would prohibit us from dealing with you.
- You must give accurate information about yourself and your cardholders, and keep it current.
- One account per business unless we agree otherwise in writing.
4. Accounts, verification and security
You sign in with a one-time code sent to your email address, so control of that mailbox is control of the account. Keep it secure, and tell us immediately at [email protected] if you think someone else has access.
Before your first card we collect cardholder identity details, and depending on the programme, the jurisdiction and the amounts involved we may need to verify identity or ask for documents — obligations that arise under the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (Cap. 615) and its equivalents elsewhere. We may pause an account or hold a card until a check completes. We may decline to open an account, and we do not have to say why.
You are responsible for everything done through your account and your API keys, including by anyone you give access to.
5. Funding your account
- Accounts are funded in USDT or USDC on Ethereum, BNB Smart Chain, Base or Kaanch Network. The dashboard shows the address to use for each.
- A deposit is credited once the network has confirmed it to the depth we require for that chain. Until then it is not spendable.
- Deposits are credited to the balance at the value we state at the time of crediting.
- You may withdraw an unspent balance subject to any verification, sanctions or fraud check then outstanding, and to any amount reserved against a pending card authorisation.
6. Cards
- Cards are virtual and are issued on Visa or Mastercard through our issuing partners. They are subject to those networks’ rules as well as to these terms.
- The minimum load on a card is $5.
- A card can be used wherever the relevant network is accepted for the type of transaction the card supports. We cannot guarantee that any particular merchant will accept any particular card — acceptance is the merchant’s decision, not ours.
- Some transactions require step-up authentication. Where the network sends a code for a card, we deliver it to the contact captured when the card was created.
- We may freeze, decline, suspend or terminate a card where we are required to, where we suspect fraud or breach of these terms, or where an issuing partner or network instructs us to.
7. Fees
Fees are shown in the dashboard and in the API before you confirm anything that costs money. The fee that applied at the moment of a transaction is recorded against that transaction, so a later change to our pricing does not rewrite what you were charged.
- Account activation is a one-time fee of $5,000, payable in KNCH on the Kaanch Network. The dashboard quotes the KNCH amount equivalent at the price held when you request it, holds that quote for one hour, and records the price used against your activation. A small tolerance is allowed against price movement between quote and payment.
- Activation is charged once per account, is payable before any card can be issued, and is not refundable once the account is activated.
- Issuance and top-up fees vary by card product and are displayed before you commit.
- Amounts spent in a currency other than the card’s currency may attract a conversion charge set by the card network and any issuer margin we disclose.
- We may change fees on notice. A change takes effect for transactions made after it does.
- Fees already charged on a completed transaction are not refundable except where the law says otherwise.
8. Acceptable use
The Acceptable Use Policy forms part of these terms and lists the businesses and conduct we cannot support. Breaking it is a breach of this agreement, and the consequences are set out there.
9. Your brand and your content
You keep everything you own. To print your logo on card art, put your name on a card and send card emails under your brand, you grant us a non-exclusive, worldwide, royalty-free licence to use that material for exactly those purposes, for as long as your programme runs.
You confirm you have the right to give us that licence, and that your brand does not infringe anyone else’s rights. If a third party claims otherwise, section 15 applies.
10. The API
- API keys are scoped to the permissions you grant them and may be restricted to an IP allowlist. Treat them as credentials.
- Rate limits are 120 read requests and 60 write requests per minute per account. We may adjust them, and may throttle or suspend a key that threatens the platform.
- Every money-moving request takes an idempotency key. Retrying with the same key returns the original result rather than repeating the action; retrying without one is your risk.
- Do not reverse engineer the platform, probe it for vulnerabilities without our written permission, scrape it, or resell access to it.
- We may change the API. Breaking changes are announced in advance where we can, but an urgent security fix may not wait.
11. Disputes, refunds and chargebacks
A cardholder dispute over a purchase is handled under the rules of the network that carried it, and those rules set what evidence is needed and how long each stage takes. Raise a dispute with us as soon as you know of it — network deadlines are short and we cannot extend them.
A refund from a merchant returns to the card it was taken from and appears once the merchant sends it. We do not control that timing. Where a chargeback goes against a cardholder, the amount may be debited from your account balance.
12. Suspension and termination
You may close your account at any time. We may suspend or close an account, or terminate a card, where you break these terms or the Acceptable Use Policy, where we are required to by law, a regulator, an issuing partner or a card network, or where continuing would expose us to unacceptable legal or fraud risk.
On termination, cards stop working, outstanding authorisations are settled or released, and any remaining balance is returned to you subject to verification and to any legal restriction on paying it out. Sections that by their nature should survive — fees owed, liability, indemnity, governing law — do.
13. Disclaimers
The platform is provided as it is and as it is available. To the fullest extent the law allows, we exclude all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
- We do not warrant that the platform will be uninterrupted, timely or error-free.
- We do not control merchants, card networks, issuing partners, blockchains or node providers, and we are not responsible for their acts, outages or decisions.
- We give no advice — legal, tax, financial or regulatory. Whether your programme is lawful where you operate is your responsibility.
- Nothing on ON5.com or ON5.org is a commitment that the ON5 Card Network will launch, or launch on any timetable.
14. Limitation of liability
Nothing in these terms excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.
Subject to that, we are not liable for indirect, incidental, special, consequential or punitive loss, nor for lost profits, lost revenue, lost business, lost goodwill or lost or corrupted data, however caused.
Subject to that, our total liability arising out of or in connection with this agreement in any twelve-month period is limited to the greater of the fees you paid us in the twelve months before the event giving rise to the claim, or one hundred United States dollars.
15. Indemnity
You will indemnify us against claims, losses, liabilities and reasonable costs arising from your use of the platform, your breach of these terms or the Acceptable Use Policy, your card programme and its cardholders, or a claim that your brand infringes someone’s rights.
16. Changes to these terms
We may change these terms. We will post the updated version with a new date, and for a material change we will email account holders before it takes effect. Continuing to use the platform after that is acceptance. If you do not accept, close your account and withdraw your balance.
17. General
- These terms, together with the Acceptable Use Policy, the Privacy Policy and the Cookie Policy, are the whole agreement between us.
- If a provision is unenforceable, the rest stands.
- Not enforcing a right once does not waive it.
- You may not assign this agreement without our written consent. We may assign it to an affiliate or to a buyer of the business.
- We are not liable for failure caused by something outside our reasonable control.
- Nothing here creates a partnership, agency or employment relationship.
18. Governing law and disputes
These terms are governed by the law of the Hong Kong Special Administrative Region of the People's Republic of China. The courts of Hong Kong have exclusive jurisdiction over any dispute arising from them. Where the law of your country of residence gives you consumer rights that cannot be overridden by contract, this clause does not take them away.
